Use Definition

Dual occupancy—

  1. (a) means a residential use of premises for 2 households involving 
    1. (i) 2 dwellings (whether attached or detached) on a single lot or 2 dwellings (whether attached or detached) on separate lots that share a common property; and
      (ii) any domestic outbuilding associated with the dwellings; but
  2. (b) does not include a residential use of premises that involves a secondary dwelling.

Examples:

Duplex, two dwellings on a single lot (whether or not attached), two dwellings within one single community title scheme under the Body Corporate and Community Management Act 1997, two dwellings within the one body corporate to which the Building Units and Group Title Act 1980 continues to apply.

Excludes:

dwelling house, multiple dwelling

Development Zone

If (a) associated with, and subordinate to a hospital use or education establishment use on the same site; and (b) for use by students or staff only, accepted subject to requirements:

If expanding the total use area of the existing use by less than 50m2 requiring: (a) no building work; or (b) minor building work, accepted subject to requirements:

If expanding the total use area of the existing use by less than 50m2 requiring: (a) no building work; or (b) minor building work, accepted subject to requirements:

If expanding the total use area of the existing use by less than 50m2 requiring: (a) no building work; or (b) minor building work, accepted subject to requirements:

If (a) expanding the total use area of the existing use by less than 50m2 requiring no building work or minor building work; and (b) the total number of dwellings on-site does not exceed two, accepted subject to requirements:

If the total numbers of dwellings on-site does not exceed two, code assessable against:

If expanding the total use area of the existing child care centre by less than 50m2 requiring (a) no building work; or (b) minor building work, accepted subject to requirements:
