Notice of Adopted Local Law

MOUNT ISA CITY COUNCIL
NOTICE OF ADOPTED LOCAL LAW

 

On 22 August 2018, Mount Isa City Council resolved to make:

  • Subordinate Local Law No. 1 (Administration) 2018 (“SLL1”);
  • Subordinate Local Law No. 2 (Animal Management) 2018 (“SLL2”);
  • Subordinate Local Law No. 3 (Community and Environment Management) 2018 (“SLL3”);
  • Subordinate Local Law No. 4 (Local Government Controlled Areas, Facilities and Roads) 2018 (“SLL4”);
  • Subordinate Local Law No. 5 (Parking) 2018 (“SLL5”);

 (collectively, “the New Subordinate Local Laws”).

The New Subordinate Local Laws repealed the following existing subordinate local laws:

  • Subordinate Local Law No. 1 (Administration) 2013;
  • Subordinate Local Law No. 2 (Animal Management) 2013;
  • Subordinate Local Law No. 3 (Community and Environment Management) 2013;
  • Subordinate Local Law No. 4 (Local Government Controlled Areas, Facilities and Roads) 2013;
  • Subordinate Local Law No. 5 (Parking) 2013.

Purpose and general effect of SLL1

SLL1 is authorised by Local Law No. 1 (Administration) 2013.

The purpose of SLL1 is to supplement Local Law No. 1 (Administration) 2013, which provides for a legal and procedural framework for the administration, implementation and enforcement of the local government's local laws, subordinate local laws and other regulatory powers, and for miscellaneous administrative matters.

The purpose is to be achieved by providing for-

  • various matters regarding the granting of approvals for prescribed activities; and
  • to provide further specification of the definitions relevant to various prescribed activities.

Purpose and general effect of SLL2

SLL2 is authorised by Local Law No. 2 (Animal Management) 2013.

The purpose of SLL2 is to supplement Local Law No. 2 (Animal Management) 2013, which provides for regulation of the keeping and control of animals within the local government's area.

The purpose is to be achieved by providing for-

  • the circumstances in which the keeping of animals is prohibited or requires approval; and
  • requirements for keeping animals, including minimum standards, mandatory desexing, proper enclosures, koala conservation and identification; and
  • the control of animals in public places; and
  • matters regarding the impounding of animals and the sale or disposal of impounded animals; and
  • the conditions to be complied with by persons who offer animals, or a particular species of animals, for sale; and
  • the declaration of a species of animal as a declared dangerous animal and the criteria for declaration of a specific animal as a declared dangerous animal.

Purpose and general effect of SLL3

SLL3 is authorised by Local Law No. 3 (Community and Environmental Management) 2013.

The purpose of SLL3 is to supplement Local Law No. 3 (Community and Environment Management) 2013 which provides for protecting the environment and public health, safety and amenity within the local government's area.

The purpose is to be achieved by providing for-

  • declaration of local pests; and
  • prohibition of lighting or maintaining certain fires; and
  • declaration of fire hazards; and
  • declaration of community safety hazards; and
  • prescribed requirements for owners of land containing community safety hazards; and
  • declaration of noise standards.

Purpose and general effect of SLL4

SLL4 is authorised by Local Law No.4 (Local Government Controlled Areas, Facilities and Roads) 2013.

The purpose of SLL4 is to supplement Local Law No.4 (Local Government Controlled Areas, Facilities and Roads) 2013 in order to protect the health and safety of persons using local government controlled land, facilities, infrastructure and roads and preserve features of the natural and built environment and other aspects of the amenity of local government controlled land, facilities, infrastructure and roads.

The purpose is to be achieved by providing for:

  • the regulation of access to local government controlled areas; and
  • the prohibition or restriction of particular activities in local government controlled areas or roads.

Purpose and general effect of SLL5

SLL5 is authorised by Local Law No.5 (Parking) 2013.

The purpose of this subordinate local law is to supplement Local Law No. 5 (Parking) 2013, which provides for the exercise of local government powers authorised under the Transport Operations (Roads Use Management) Act 1995.

The purpose is to be achieved by providing for-

  • the establishment of traffic areas and off-street regulated parking areas; and
  • the persons who may be issued with a permit to park a vehicle contrary to an indication on an official traffic sign; and
  • the vehicles that can be issued with commercial vehicle identification labels; and
  • the infringement notice penalty amounts for minor traffic offences.

Anti-Competitive Provisions

The New Local Laws contain anti-competitive provisions.

A copy of the New Subordinate Local Laws may be inspected and purchased at Council’s public office at Administration Building, 23 West Street, Mount Isa Qld 4825.

A copy of the New Subordinate Local Laws may also be viewed by the public on Council’s website and the Department of Local Government, Racing and Multicultural Affairs’ website.
